UDAAP is law (Section 5 of the Federal Trade Commission Act). The challenge today, more than ever, is that what is deemed “illegal” under the Act has become a moving and expanding target. To understand UDAAP today, you have to pay close attention to what the regulators, particularly the CFPB, are saying about what they consider violations and what constitutes consumer harm, or risk of consumer harm.

We will cover UDAAP as Section 5 of the Federal Trade Commission Act defines “unfair”, “deceptive” and “abusive” acts or practices. We will also discuss:

  • Recent agency policy statements, circulars, bulletins and other public statements regarding activities that are considered UDAAP violations and, ultimately, violations of the Consumer Financial Protection Act
  • Recent actions taken against banks and nonbanks invoking UDAAP
  • What used to be standard banking practice may be deemed ‘illegal” now, even if it’s clearly and conspicuously disclosed to consumers
  • Steps you should take to evaluate your UDAAP risk
  • Steps you should take to mitigate your UDAAP risk – regulators are providing guidance
